1. Parties
This agreement will be made between You (the Subscriber) and Railnews Limited of 95 Wellingborough Road, Finedon, Wellingborough NN9 5LG, who is registered as a company in England and Wales under registration 03260010.
2. Formation
You shall invite us to enter into this agreement by one of the following methods:
2.1 The “Submit Order” button is clicked through our website;
2.2 You post details and payment to us; or
2.3 You provide your payment details to us over the telephone;
Once we have accepted your order, payment shall be taken and the agreement shall become valid. Confirmation of this shall be provided via email or post if requested, along with appropriate receipt.
Railnews reserve the right to refuse any order or cancel orders up to the point of agreement formation for any reason. We will always endeavour to advise you as soon as possible in this event.
3. Cancellation & Refunds
Subscriptions may be cancelled in writing giving 30 days’ notice. A refund to the value of any unmailed issues following cancellation, minus a £5 cancellation fee, shall be made within 21 days of receipt of cancellation by the same method as payment.
4. Delivery
Delivery shall be made the address supplied when entering into this agreement. Railnews shall be under no liability for non-delivery if this address was incorrectly supplied. The delivery address may be changed with 5 working days’ notice by calling 01438 281200 or by writing to Railnews Subscriptions, Caxton Point, Caxton Way, Stevenage SG1 2XU.
An annual delivery schedule is published on 1st January each year and is available on request.
5. Non-Delivery
We will not be liable to you for any delay in delivery or non-delivery of magazines in the following circumstances:
5.1 Where an attempt to take payment via the agreed method has failed;
5.2 Where such delay or failure is due to circumstances beyond our control or the control of our sub–contractors and agents, including but not restricted to war, electricity power failure, utilities failure, failure of telecommunications links, failure of transport infrastructure, fire, flood, government act, act of God, legislative constraints, strikes, labour disputes or malicious damage involving employees;
Reporting of a non-delivery should be made within 28 days of scheduled delivery date. Reports following this period cannot guarantee compensation. Compensation for non-delivery is at the discretion of Railnews and is limited to replacement of non-delivered issues or extension of subscription period.
6. Prices
Subscription prices shall be fixed for fixed-period subscription (eg: 12 month, 18 month). Prices for flexible subscriptions shall be fixed only for the first 3 months after which price alterations may be made by us giving you 30 days’ notice. Price alterations shall be advertised to affected current subscribers via email or post and also advertised via our website (www.railnews.co.uk).
7. Personal Information
We shall use your personal information in the course of fulfilling this agreement by means of payment transaction, personal correspondence and mailing fulfilment.
Railnews will not sell or provide your information to third parties unless required to do so by law.
8. Variation
These Terms & Conditions are subject to change, from time to time.
9. Governing Law
These Terms & Conditions are governed by English law.
10. Entire Agreement
These Terms & Conditions override any previously published.
